Lease Cancellation Sought Against Jaina Properties: A Matter of Public Safety

The residents and flat occupiers of T.C. Jaina Tower-I and II, Janakpuri have raised a grave alarm. Through their registered Welfare Association, they have submitted formal complaints to the Delhi Development Authority (DDA), the Lieutenant Governor of Delhi, and the Central Vigilance Commission, demanding the immediate cancellation of Jaina Properties Pvt. Ltd.’s lease for the Towers.

Why the Demand for Cancellation?

The complaints, supported by DDA’s own inspection reports, document serious and repeated violations by Jaina Properties:

  1. Massive Unauthorized Construction & Encroachments
    • DDA’s inspection reports (06/06/2024, 23/10/2024, and 24/05/2025) confirm large-scale deviations and encroachments.
    • Common areas, meant for public use, have been misused for private profit.
  2. Grave Fire Safety Violations
    • Despite clear objections from the Fire Department, the builder converted the Fire Control Room into a shop and rented it out for lakhs of rupees.
    • This reckless act compromises the safety of hundreds of occupants and visitors.
  3. Fraudulent Litigation to Protect Illegal Acts
    • The builder created a fake shell association to obtain stay orders in court (Suits No. 104/2010, 366/2012, and 70/2001).
    • Genuine occupants, many of whom have been in possession for 20–23 years, were never represented by this proxy association.
    • Records reveal that members of the builder’s own family, including directors of Jaina Properties, were behind this sham entity.
  4. Cheating Innocent Investors
    • Hundreds of small shop owners, who invested their life savings, are now facing harassment, false cases, and threats of dispossession.

A Clear Breach of Trust and Law

These actions are not just technical violations. They represent:

  • Breach of lease terms agreed with the DDA.
  • Endangerment of public safety, with fire hazards and structural misuse.
  • Manipulation of the legal system to stall enforcement.
  • Cheating and exploitation of ordinary investors who trusted the builder.

The Prayer from Residents

The Welfare Association has requested that authorities:

  • Cancel the lease of Jaina Properties Pvt. Ltd. for Jaina Tower-I & II.
  • Take direct control of the buildings in the interest of public safety.
  • Initiate penal action against the builder for fraud, encroachment, and misuse.

Why This Matters

This case goes far beyond one building. It is about whether powerful builders can openly flout laws, endanger lives, and exploit ordinary citizens without consequence. The outcome will determine if residents in Delhi can trust the system to protect them — or if impunity will continue.

The ball is now in the court of the DDA, the Lieutenant Governor, and vigilance authorities. The residents have spoken. The question is: will Delhi’s institutions act before it is too late?
